Hardship and Avoiding Preference

Join us for the first Tasmanian Credit Network Night. Two experienced credit professionals will cover important topics within the industry. Neil Smith from Transurban will cover hardship and Frank Gambera from McMahon Fearnley Lawyers will discuss avoiding preferences. We will also have a special guest speaker, Darren Thurlow from Rural Alive & Well (RAW) and he will be speaking about the fantastic work they do.

- Secured creditor defence - How to utilise the other defences under the Corporations Act

-The evolving Law around PPSA

Frank will also discuss how Credit Managers have been able to raise an additional defence to preference claims made by liquidators. Credit managers who register a security interest under the PPSA may argue that as a secured creditor their company is not exposed to preference claims which concern unsecured debt.
